Petitioners apprehend their arrest in Hisua P.S. case no. 74 of 2018 instituted for the offence under Section(s) 467,468,420 and 120B of the Indian Penal Code.

In the written report filed by BDO, it is alleged that these petitioners being member of the committee have withdrawn Rs. 19,84,814 on 27.9.2017, Rs. 6,85,500/- on 2.11.2017 and Rs. 469840/- on 30.1.2018 total amounting to Rs. 31,40154/- for execution of the different project of the Gram panchayat. The aforesaid amount withdrawn was for the construction of drain, its cover as well as water pump in different streets of ward no. 12 in Kaithir Gram Panchayat under Chief Minster Seven

Learned counsel for the petitioner has submitted that in paragraph nos. 10 and 11 of the case diary witnesses have stated that work has been done.

Learned APP for the State, on the other hand, submitted that there are statement of some witnesses but there is no supporting document to show that work has been completed by the petitioners.

In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioners. Prayer for anticipatory bail of the petitioners stand rejected.

Petitioners may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
