The petitioners are apprehending their arrest in connection with Mednichowki P.S.Case No. 16 of 2017 registered for the offences punishable under Sections 363 and 366/34 of the Indian Penal Code.

Allegation against the petitioners is that they have forcibly taken the daughter of the informant thereafter she was taken to Rohtak.

It has been submitted on behalf of the petitioners that in her statement under Section 164 Cr.P.C. the victim girl has not named the petitioners and it has come from her statement that there was love affairs between co-accused and daughter of

Patna High Court Cr.Misc. No.33601 of 2017 (2) dt.20-07-2017 2/2 informant and petitioners have falsely been implicated in this case. Heard learned APP also.

Having heard both sides and in view of the allegation, it is not a fit case for grant of anticipatory bail to the petitioners. Let petitioners surrender before the court below and pray for regular bail, which shall be considered on the basis of submission made above and the statement made under Section 164 Cr.P.C. of the victim girl and the court below will dispose of the bail application of the petitioners.

With the above observation, this application is dismissed.
