The petitioner seeks bail in Lalganj P.S. Case No. 231 of 2020 registered for the offence under Sections 413, 414, 420, 467 and 468 of the Indian Penal Code.

As per the prosecution case, three persons, who were riding on a motorcycle, suddenly started fleeing away on seeing the police party. Thereafter, on chase, they were apprehended and from possession of this petitioner, one duplicate key of unlocking motorcycle was recovered. It is submitted on behalf of petitioner that petitioner is innocent and has falsely been implicated in this case. Petitioner has got no criminal antecedent and he is in custody since 08-08-2020. It is further submitted that two other coaccused have already been granted bail by this Court, vide order

Patna High Court CR. MISC. No.40757 of 2020(2) dt.26-02-2021 2/2 dated 15-01-2021 passed in Cr.Misc. No. 35715 of 2020 (Nitish Kumar) and 27-01-2021 passed in Cr. Misc. No. 36054 of 2020 (Sushil Singh). Chargesheet has already been submitted. Considering the aforesaid facts and circumstances as well as nature of accusation, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IX, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 231 of 2020 on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
