Apprehending his arrest in Kudhani P.S. Case No. 394 of 2016 registered under sections 401, 414 and 120-B/34 IPC, the petitioner has filed the present application for grant of anticipatory bail.
On disclosure of the accused persons who were found possessed of fire arms and other incriminating articles, the search was carried out from the house of the petitioner and stolen clothes were recovered.
It is stated that the seizure list does not carry the signature of any family member. The petitioner runs a Kirana shop.
Mr. Dayal, APP, on the other hand, points out that
Patna High Court Cr.Misc. No.21118 of 2017 (2) dt.01-07-2017 2/2 on disclosure made by several accused persons the recovery of stolen clothes was made from the house of the petitioner. The gang of criminals used to commit crime and the petitioner used to purchase those looted/stolen clothes/articles. Considering the nature of the allegation and other materials available on record, I am not persuaded to extend the privilege of anticipatory bail to the petitioner. Prayer is accordingly rejected.
The petitioner shall surrender and prayer for regular bail.
