JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-07-2017 The appellant seeks pre arrest bail in connection with Sitamari SC/ST P.S.Case No.81 of 2016 registered for offences punishable under Sections 341, 323, 504, 379, 354/34 of the Indian Penal Code and Section of 3(i)(s)(w)(i) of SC/ST (Prevention of Atrocities) Act.

Submission of the learned counsel for the appellant is that there is delay in lodging the F.I.R. of four days and it is further submitted that earlier to that the appellant had filed a case against the informant and others with respect to assault to his servant and due to which the present case has been lodged. It is also submitted that earlier the appellant had been granted police bail.

Heard learned Special P.P. also, who has opposed the

Patna High Court CR. APP (SJ) No.1610 of 2017 (3) dt.01-07-2017 2/2 prayer for pre-arrest bail on the ground that there is clear allegation against this appellant of abusing the informant by taking his caste name, as such, this appeal is not maintainable. Let the appellant surrender before the court of Special Judge and make prayer for regular bail and the learned Special Judge after considering aforesaid submissions and other materials available on the record will pass appropriate order and dispose of the prayer for bail of the appellant, if possible on the same day.
