Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-07-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Amarpur P.S. Case No. 206 of 1992 (S.T. No. 156 of 2019) for the offence under Sections 146, 148, 447, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 16.03.2019. He further submits that in the instant case the petitioner was granted bail during course of investigation and without issuing any process, the bail bonds of the petitioner was cancelled.
Considering the fact that the petitioner was earlier granted bail on merit, the petitioner, named above, is directed to
Patna High Court CR. MISC. No.47767 of 2019(2) dt.31-07-2019 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Banka in connection with Amarpur P.S. Case No. 206 of 1992 (S.T. No. 156 of 2019) with the condition that the petitioner shall cooperate in conclusion of the trial and without any cogent reason he shall not be absent in the court proceeding. In the event, the petitioner fails to present in the court on two consecutive dates in the trial, the court below shall be at liberty to cancel his bail bonds.
