This application for regular bail arises out of Rajaun P.S. Case No. 75 of 2020, disclosing offence punishable under Sections 302/201/34 of the Indian Penal Code. The petitioner is father-in-law of the deceased. He had earlier approached this Court seeking grant of regular bail, which was rejected by an order dated 15.01.2021, passed in Cr. Misc. No. 31609 of 2020 after perusal of the case diary. From the said order dated 15.01.2021, it transpires that allegedly the petitioner had made confessional statement before the police to the effect that the deceased was killed by his son and the dead body was cut into pieces by him and his son.
Learned Senior Counsel appearing on behalf of the
Patna High Court CR. MISC. No.56954 of 2021(2) dt.24-11-2021 2/2 petitioner has submitted that the main accused Suman Kumar Choudhary, the husband of the deceased, has been allowed regular bail by this Court by an order dated 03.08.2021, passed in Cr. Misc. No. 2693 of 2021.
Considering the fact that co-accused Suman Kumar Choudhary has been allowed privilege of regular bail by this Court, this application is allowed. Let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Banka, in Rajaun P.S. Case No. 75 of 2020.
