JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 26-11-2015 The petitioner seeks compensation of Rs.10 lacs as her son Shiv Shankar @ Dharkan died on account of electrocution. The petitioner's case is that her 10 year old son while returning from market on his bi-cycle by village road, came across live electric wire which was lying on the ground unattended. The body was subjected to post mortem, which confirmed that the boy died on account of electric shock. A U.D. Case No. 4/10, dated 22.8.2010 as also registered in which the police submitted final form in the Court of the S.D.O., Begusarai stating the boy died due to electric current.

Having considered the facts and circumstances of the case,

Patna High Court CWJC No.18323 of 2013 (6) dt.26-11-2015 the appropriate authority of the Electricity Board, now the Power Holding Company, would take necessary decision with respect to payment of compensation to the petitioner within a period of two months from the date of receipt/production of a copy of this order. In case the petitioner is aggrieved by the quantum of compensation, it would be open for her to move the Human Rights Commission.

With the aforesaid observations and directions, this writ application stands disposed of.
