JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 11-07-2023 Heard Mr. Rajiv Nayan Singh, learned counsel appearing on behalf of the petitioner and Mr. Jay Prakash Sharma, learned counsel appearing on behalf of the State.

2. Learned counsel appearing on behalf of the State informs that the petitioner has filed the present writ petition for payment of gratuity in accordance with provisions of Gratuity Act, 1972.

3. The petitioner had superannuated on 31.01.1996. The writ petition was filed in the year 2012 for non-payment of gratuity. Till date information regarding payment has not been

Patna High Court CWJC No.14206 of 2012 dt.11-07-2023 2/2 given taking into consideration the Rules / Regulations applicable to the employees of the Patna Municipal Corporation and then erstwhile Patna Regional Development Authority.

4. The Municipal Commissioner must ensure to verify the records and also ensure that payments are made to the petitioner/his legal heirs, if already not made, within a period of six weeks from the date of communication of this order.

5. The State Counsel must ensure to communicate a copy of this order to the Patna Municipal Commissioner.

6. With the above observations and directions, the present writ petition stands disposed of.
