JUSTICE ARUN KUMAR ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 419, 420, 34 of the Indian Penal Code.

Allegation in brief is that some another co-accused apprehended in the examination centre was appearing in place of this petitioner in Intermediate Examination conducted by Bihar School Examination Board.

It is submitted that this petitioner has no knowledge who appeared on whose instruction.

However, the person impersonating him apprehended in the examination hall by giving examination with the Admit Card of the petitioner, so it is not a case of anticipatory bail.

Patna High Court Cr.Misc. No.30317 of 2017 (2) dt.10-07-2017 2/2 Accordingly, the prayer for anticipatory bail of the petitioner, namely, Sury Narayan Yadav in connection with Pandaul P.S. Case No.23 of 2017 pending in the court of C.J.M., Madhubani is rejected.
