JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-07-2019 This is an application for grant of anticipatory bail in connection with Dhoraiya P.S. Case No. 232 of 2018, disclosing offences under Sections 30(a) and 32(2) of the Bihar Prohibition and Excise Act, 2016.

As per written statement of the police a motorcycle was intercepted, two persons were arrested and 20 liters of illicit liquor has been recovered from the said motorcycle. Petitioner is not named in the F.I.R. but later on, transpired that he is owner of the motorcycle.

Submission of the learned counsel for the petitioner is that F.I.R. itself shows that he was not present there and he has handed over the motorcycle to co-accused persons, who misused the same.
