2. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 506 & 379/34 of the Indian Penal Code.

3. All the F.I.R. named accused including this petitioner is said to have assaulted the informant's son and his family members.

4. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to land dispute. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Both the parties are agnates and there is admitted land dispute between the parties. It is

No.50173 of 2024(3) dt.13-09-2024 2/2 further submitted that the real fact of the matter is that the informant's side is trying to grab the land of the petitioner's side for which the scuffle took place. Petitioner has no criminal antecedent as mentioned in para-3 of this application and he is languishing in judicial custody since 08.04.2024.

5. Learned APP for the State and informant opposed the prayer for bail.

6. Having regard to the facts and circumstances of the case as well as the fact that the injury sustained by the victim has not been inflicted by the petitioner, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Phulwaria P.S. Case No. 113 of 2024.
