Petitioners apprehend their arrest in connection with Barbigha P.S.Case No. 22 of 2018 registered for the offences punishable under Sections 448, 148, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.

Petitioners are not named in the FIR and there is allegation of assault against other co-accused persons. Submission of learned counsel for the petitioners is that there is no overt act against the petitioners and there is case and counter case between the parties and prior to the present case a case has been lodged by the petitioner's side against the informant. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.45001 of 2018 (3) dt.01-08-2018 2/2 circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura, in connection with Barbigha P.S.Case No. 22 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
