After some argument, the learned counsel for the petitioner very fairly submits that out of five prosecution witnesses, three prosecution witnesses have already been examined and only I.O. and the doctor remains to be examined and as such, seeks permission to withdraw the present bail application.
Permission is accorded with a direction to the learned Court below to ensure that the trial is completed within a period of three months from the date of receipt/ production of a copy of this order.
The District Magistrate and the Superintendent of Police, Samastipur are directed to ensure that the official
Patna High Court CR. MISC. No.56770 of 2021(4) dt.09-05-2022 2/2 witnesses i.e. the doctor and the I.O. should appear in the trial as and when required by the learned Court below. In the event, if it is found that the doctor and the I.O. have not appeared in the trial despite being summoned by the learned Court below, it will be presumed that the District Magistrate and the Superintendent of Police, Samastipur are not taking interest in the case. In the event, if the trial is not concluded within three months as aforesaid, the petitioner will be at liberty to renew his prayer for bail before the learned Court below itself.
With the aforesaid observation and direction, this application stands disposed of.
