The petitioner seeks bail in Gwalpara P.S. Case No. 15 of 2019, instituted for the offence under Section(s) 394 of Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The looted Motorcycle has been recovered from the house of co-accused Sintu Yadav. The police during investigation has arrested co-accused Manish Choudhary and petitioner on 31.1.2019 on suspicion. The Police has recorded confessional statement of Manish Chaudhary. He disclosed the name of petitioner.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Shiv Kumar, learned Judicial Magistrate, 1st Class, UdaKishunganj, Madhepura, in connection with in Gwalpara P.S.
