The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406 of the Indian Penal Code.
It is alleged that this petitioner has not executed the sale deed in favour of the informant in spite of receiving consideration amount of Rs. 5,20,000/-.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.55969 of 2021(6) dt.19-09-2022 2/3 petitioner that petitioner has falsely been implicated in this case. There is no documentary proof with respect to handing over consideration amount to the petitioner. The informant has inimical term with the petitioner from before, hence, this false case has been lodged against the petitioner. Moreover, for a civil nature of dispute, the petitioner has been roped in the present criminal proceeding. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.
In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 60 of 2021, subject to the conditions as laid down
