JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 01-12-2021 Learned counsel for the petitioner undertakes to remove all the defects as pointed out by office within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Bal Mukund Prasad Sinha, learned A.P.P. for the State as well as Mr. Manoj Kumar Singh, learned counsel for the Union of India. This is the second attempt of the petitioner to obtain bail in connection with N.C.B. Case No.35/2018, Special Case No.76/2018 registered for the offences punishable under Sections 8/20/23/25/27(A)/29 of the NDPS Act. Earlier vide order dated 23.01.2020 passed in

Patna High Court CR. MISC. No.57360 of 2021(3) dt.01-12-2021 2/3 Cr.Misc.No.62425 of 2019 this Court had refused to enlarge the petitioner on bail with an observation that the petitioner may renew his prayer for bail if the trial is not concluded within a reasonable period.

Learned counsel for the petitioner submits that the trial is not progressing since the date of first rejection. Having regard to the facts and circumstances of the case wherein the prayer for bail of the petitioner was earlier rejected by this Court vide order dated 23.01.2020 passed in Cr.Misc.No.62425 of 2019 and that the trial in this case has already began, this Court is not inclined to release the petitioner on bail at this stage.

Learned counsel for the petitioner has drawn the attention of this Court towards the period of custody of the petitioner i.e. since 21.07.2018.

Taking note of it, this Court directs the learned trial court to conclude the trial as early as possible and preferably within a period of six months from the date of communication of this order. The records of this case be kept on shorter dates. No unnecessary adjournment be granted and the parties must cooperate in early conclusion of the trial.

If the trial still remains unconcluded during this
