====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2024 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120(b) of the Indian Penal Code.
3. According to F.I.R., all the accused persons misappropriated amount of Rs. 22,44,104/- of common investors by filing forged insurances.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during course of investigation. From perusal of the F.I.R. it is apparent that proprietor of M/s Nagina Motors is co-accused Hemant Kumar, who is son of this petitioner. Petitioner is separate in mess and property and he has got no concern with

Moreover, co-accused Hemant Kumar has already been granted bail by co-ordinate Bench of this court vide order dated 26.02.2016 passed in Cr. Misc. No. 26036 of 2015 (Annexure-P/2) as well as other coaccused persons have also been granted bail vide Cr. Misc. No. 13134 of 2016 and Cr. Misc. No. 18333 of 2016 (AnnexureP/3).
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Nagar P. S. Case No. 478 of 2014, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
