2. The petitioner is in custody since 01.07.2022 in connection with Kanti P.S. Case No. 84/2022 registered for the offence punishable under Sections 399/402 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act and Sections 8/22 of the N.D.P.S. Act.
3. The petitioner is accused of planning to commit dacoity.
3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to dirty village politics. He further submits that his name surfaced during the course of investigation by the co-accused persons. It is next submitted that no incriminating article has been recovered from the possession of the petitioner and he was not
Patna High Court CR. MISC. No.46633 of 2023(2) dt.28-07-2023 2/2 arrested on the spot.
4. However, learned A.P.P. appearing on behalf of the State vehemently opposed the bail application.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Muzaffarpur in connection with Kanti P.S. Case No. 84/2022.
6. The petitioner is directed to appear before the concerned Police Station on the 1st Sunday of each month. (Sandeep Kumar, J) Saif/- U T
