JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bakhtiyarpur P.S. Case No. 482 of 2018 registered for the offences punishable under Sections 420, 467, 468, 470 and 471/34 of the Indian Penal Code. Submission of learned counsel for the petitioner is that earlier petitioner was granted anticipatory bail and directed to surrender within 21 days, which will appear from Annexure2. However, as the petitioner was arrested in connection with other case on 5.3.2019 he could not appear before the court below as directed by learned Sessions Judge vide order dated 22.2.2019 (Annexure-2) and after release of the petitioner in that case petitioner filed an application for extension of time before learned Sessions Judge, which has been rejected. Heard learned APP also.

Patna High Court CR. MISC. No.43863 of 2019(2) dt.17-07-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if he surrenders and prays for regular bail, the court below shall consider the aforesaid aspects of the matter and disposed it of on the same day, if possible. With the above observation, this application is disposed of.
