Mr. Vivekanand Singh, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-11-2022 Heard learned counsel for the petitioners, learned APP for the State as well as learned counsel appearing on behalf of the informant.

The petitioners apprehend their arrest in connection with K. Hat (Sahayak) P.S. Case No.530 of 2021, registered for the offences punishable under Sections 406, 418, 420, 341, 323, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is further submitted that the petitioners have got one criminal antecedent as stated in paragraph-3 of the bail petition. Learned counsel for the petitioners fairly accepts that

Patna High Court CR. MISC. No.57674 of 2021(4) dt.01-11-2022 2/2 the petitioners have taken Rs.7,00,000/- from the informant and they are ready to return the said amount to the informant. In view of the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on provisional bail for a period of six months on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Sahayak) P.S. Case No.530 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.

The petitioners are agree to return Rs.7,00,000/- to the informant in three installments within a period of six months. If the petitioners return Rs.7,00,000/- to the informant in three installments within a period of six months, the learned court below shall confirm the provisional bail of the petitioners granted by this Court.
