The petitioner seeks bail in Ahiapur P.S. Case No. 167 of 2020, registered for the offence under Sections 341, 323, 354, 354(A), 504/34 of the Indian Penal Code and Section 8 / 18 of the POCSO Act.

As per the F.I.R., the allegation against this petitioner and other two co-accused is that they tried to take away the minor daughter of the informant, however; she could be saved by the guard on duty and the guard identified the petitioner and other co-accused.

Submission of petitioner is of false implication, as at the relevant time, the petitioner was at Patna in connection with treatment of his cousin brother. Other co-accused namely

Patna High Court CR. MISC. No.56795 of 2021(2) dt.10-12-2021 2/2 Ranveer Kumar and Mithu Kumar have already been granted bail by this Court, vide order dated 07.07.2020 passed in Cr.Misc. No. 21724 of 2020 and order dated 11.09.2020 passed in Cr.Misc. No. 22874 of 2020 respectively (Annexure 3 series). Petitioner has got clean antecedent and he is in custody since 08.08.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the period of custody and the fact that other co-accused have been granted bail, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge I cum Special Judge (POCSO Act), Muzaffarpur in connection with Ahiyapur P.S. Case No. 167 of 2020.
