JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 17.5.2014 in a case registered for the offences punishable under Sections 147,148,149,307 and 302 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged that the petitioner ordered to kill the informant's son and thereafter caused fire arm injury on the head of the victim. Co-accused Parashuram caused fire arm injury on the neck of the informant's son whereas Udai Singh caused firearm injury on the hand of the son of the informant who died on the spot.
It is submitted by the learned counsel for the petitioner that co accused have been acquitted vide S.T. No. 247 of 1999 whereas co accused Parshuram Singh has been granted bail on 9.3.2006.
Patna High Court Cr.Misc. No.38576 of 2014 (4) dt.16-02-2015 Considering the fact that in the case of 1998, the petitioner was arrested on 17.5.2014, this court is not inclined to interfere.
This application is accordingly dismissed.
