The present appeal has been filed under Section 14 (a)

(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as 'SC/ST Act') against rejection of prayer for anticipatory bail by the court below.

Appellant is accused in Motihari Mufassil P.S. Case No. 106 of 2016 under Sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 302, 447, 504 of the Indian Penal Code and Sections 3(i)(x) of SC/ST Act.

It is evident that on earlier occasion also, the appellant had filed an appeal, vide Cr. Appeal (SJ) No. 298 of 2018,

Patna High Court CR. APP (SJ) No.2671 of 2018(3) dt.19-09-2018 2/2 which stood dismissed on 07-03-2018, as it was barred by limitation and again thereafter, the present appeal has been filed. In the F.I.R. itself, the appellant was arrayed as accused for such offence. The F.I.R. was lodged in the year 2016, still the appellant is approaching this Court again-andagain for anticipatory bail. Considering the nature of allegation as well as restriction imposed under the provision of SC/ST Act, there is no reason to entertain the prayer for anticipatory bail. The prayer for bail stands dismissed.

Let a copy of this order be sent to concerned Superintendent of Police to examine as to under what circumstances the appellant is still at large. (Rakesh Kumar, J.) anay U T
