JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-10-2021 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 420, 120B, 201 of the Indian Penal Code and u/s 13(2) of the Prevention of Corruption Act.

Prayer for anticipatory bail of this petitioner was earlier rejected by this court vide order dated 06.03.2020 passed in Cr. Misc. No. 74927 of 2019. Through this petition the petitioner has renewed his prayer for anticipatory bail on the strength of Annexure-3 of this petition. It is submitted that FIR was lodged on 23.07.2016 whereas the petitioner has handed over required charge to his successor on 05.10.2008 and thus, the petitioner deserves pre arrest bail.

Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.56477 of 2021(2) dt.06-10-2021 2/2 anticipatory bail.

Considering the facts and circumstances of the case and the submission of the parties, I do not find any fresh ground to reconsider the prayer of petitioner for anticipatory bail. Accordingly, the same is rejected.
