JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioner seeks regular bail in connection with Siwan Muffasil P.S. Case No. 113 of 2019, registered for offences punishable under Sections 302 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and others is of causing murder of son of the informant.

It has been submitted on behalf of the petitioner that the F.I.R. itself shows that the informant has heard the sound of firing on which, he went there and saw three persons, namely, Imran Ali, Firoz Ali and Danish carrying the dead body of his son and later on during trial, the informant has taken the name of these three persons, on which, summon under Section 319 Cr.P.C. was issued against those three persons to appear and face trial and, thereafter, de novo trial has started. Patna High Court CR. MISC. No.46788 of 2019(6) dt.03-03-2020 2/2 submission is that petitioner has no criminal antecedent and he has been in custody since 13.03.2019.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Siwan Muffasil P.S. Case No. 113 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
