The petitioner apprehends his arrest in connection with Nagar Bettiah P.S. Case No.55 of 2022 instituted under Sections 506,420,467,468,120B, 384 of the I.P.C. As per the prosecution story, the informant has alleged that he is residing with the family for 70 years peacefully, but the petitioner who has purchased the adjoining land along with the land 'Mafiyas' have threatened him and demanded Rs.25,000,00/- as 'Rangdari'. The further allegation of forging documents and conniving with the revenue officials. Learned counsel for the petitioner submits that he has purchased the adjoining plot and a person who has invested
Patna High Court CR. MISC. No.46314 of 2022(3) dt.03-01-2023 2/3 Rs.50,00,000/- for a piece of land, it is unbecoming of him of demanding 'Rangdari' of Rs.25,00,000/-. Actually being angered by the purchase of the adjoining plot, informant's side lodged number of criminal cases against him and he is fighting the same. It is his last submission that he always wants good relationship with his neighbour, the informant included and any misgiving that the informant may be having, he would like to sort it out.
On the other hand, learned counsel for the informant submits that he is in league with the land 'Mafiyas' and always keep threatening the informant and his family members and even the land in question is disputed inasmuch as the same belong to his family which has been illegally purchased by him. Taking into account the aforesaid facts that the petitioner has purchased the land and there arose dispute between the parties, the para-3 shows that the cases have come up only after the purchase of the land, the learned counsel for the petitioner has submitted that he would like to have peaceful co-existence with the neighbour, the informant included, this Court is inclined to grant him relief.
Let the petitioner be released on bail, in the event of his arrest or surrender before the Sub-ordinate court within a
Patna High Court CR. MISC. No.46314 of 2022(3) dt.03-01-2023 3/3 period of four weeks from the receipt of this order, on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) each with two sureties of the like amount each in connection with Nagar Bettiah P.S. Case No.55 of 2022 to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
