Petitioner seeks regular bail in connection with Alamnagar (Ratwara O.P.) P.S. Case No. 209 of 2018 registered for the offence under Section 302 / 201 / 120 (B), 34 of the I.P.C. and Section 27 of the Arms Act.
The allegation as per the First Information Report is that the son of the informant was called by the F.I.R. named accused persons (11 in number) in order to give him money for purchase of the land and they killed the son of the informant on that pretext.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to village
Patna High Court CR. MISC. No.647 of 2021(3) dt.03-05-2021 2/3 politics and he has not committed any offence in the manner alleged. Learned counsel next submits that land dispute of the deceased was with Manish Mandal and not with the petitioner. Learned counsel next submits that previously for murder of the father of the deceased the petitioner was not made accused and some other persons were accused in that case. Learned counsel next submits that similarly situated co-accused namely, Manish Mandal and Munna Mandal have been granted bail by different Co-ordinate Benches of this Court vide Cr. Misc. Nos. 38465 of 2019 & 21304 of 2020 respectively, petitioner is in custody since 20/08/2020 and Manish Mandal was having 04 criminal cases against him.
Having regard to the submissions made by learned counsel for the parties and taking into consideration the materials available on record, nature of allegation and the fact that similarly situated co-accused persons have been granted bail by different Co-ordinate Benches of this Court, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Uda Kishunganj, District -

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
