The petitioner seeks bail in a case registered under Sections 304(B), 201/34 of the Indian Penal Code.
Allegation is that the accused persons including the petitioner caused death of the daughter of the informant due to non-fulfilment of demand of dowry.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.4.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. As per the statements of the witnesses in paragraphs 10 and 43 of the case diary, the deceased is said to
Patna High Court CR. MISC. No.43037 of 2019(2) dt.15-07-2019 2/2 have committed suicide. It is further submitted that inspite of that the police has submitted charge sheet under Section 364/34 of I.P.C. There is no allegation of abduction of the victim against the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. V, Siwan in connection with Maharajganj P.S. case No.257 of 2018.
