1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Ramkrishna Nagar P.S. Case No. 43 of 2023 arising out of Complaint Case No. 10525 of 2022 registered under Sections 323, 234, 325, 307, 498A of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that from perusal of Annexure-2, it is apparent that earlier
Patna High Court CR. MISC. No.46745 of 2023(2) dt.11-08-2023 2/2 petitioner has filed matrimonial case for decree of divorce before the Family Court. Thereafter, in retaliation of that case, the petitioner has been implicated in the present case.
4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Judicial Magistrate-I, Patna in connection with Ramkrishna Nagar P.S. Case No. 43 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
