2. The petitioners seek bail in a case registered for the offence punishable under Sections 341, 323, 324, 326, 307, 379, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioners along with other co-accused persons are said to have assaulted the informant and her family members.
4. Learned counsel for the petitioners submits that no such occurrence as alleged ever took place. They are quite innocent and have been falsely implicated in this case. The allegation levelled against the petitioners is not specific rather
Patna High Court CR. MISC. No.48950 of 2024(2) dt.07-08-2024 2/2 general and omnibus in nature. He submits that the petitioners and the informant are close relatives and land dispute is going on between the parties. The petitioners have no criminal antecedent and have been languishing in custody since 26.04.2024.
5. Learned APP for the State as well as learned counsel for the informant opposed the bail petition and submitted that there is specific allegation against the petitioners of assaulting the informant's son and daughter.
6. Considering the facts aforesaid and the custody of the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Barauli P.S. Case No. 307 of 2023.
