The petitioner apprehends his arrest in connection with Kartaha P.S. Case No. 55 of 2016 registered under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the I.P.C. pending in the Court of C.J.M., Vaishali at Hajipur.

Learned counsel for the petitioner submits that petitioner was released on police bail under section 41(1) of the Code of Criminal Procedure.

Considering the facts and circumstances of the case, it appears that the matter is well covered by the decision of this Court in the case of Mahendra Prasad Singh Vs. State of Bihar, reported in 2004(3) P.L.J.R., 491.

Patna High Court Cr.Misc. No.31493 of 2017 (2) dt.19-07-2017 2/2 In view of the above, it is directed that petitioner may surrender before the Court below within a period of four weeks from today. In case, petitioner surrenders and file his application for bail, the concerned Court will pass an order in the similar manner as has been decided in the case of Mahendra Prasad Singh (supra).

The application stands disposed of with the above observations/directions.
