JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-12-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the prosecution case, while the informant was going to deposit Rs. 4,16,110/- in the State Bank of India two miscreants intercepted him and on the point of pistol snatched the bag containing Rs. 4,16, 110/-. They also snatched Adhar Card, PAN card and ATM card of Mukesh Kumar and fled away.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation. No incriminating article has been recovered from the possession of

Patna High Court CR. MISC. No.56178 of 2021(2) dt.07-12-2021 2/2 the petitioner and till date the petitioner has not been put on Test Identification Parade. Petitioner is in custody since 19.05.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that one motor cycle, cash of Rs. 13,500/- one mobile, Adhar Card, PAN card, pass book and two cheque books of the informant have been recovered from the house of this petitioner.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
