The petitioner seeks bail in Maharajganj P.S. Case No. 18 of 2019 (Sessions Trial No. 186 of 2019), instituted for the offence under Section(s) 147, 148, 149, 341, 323, 324, 307, 379, 506 of Indian Penal Code. Subsequently, Section 302 of Indian Penal Code was added.

It is alleged in the written report that co-accused Dhara Singh inflicted knife blow to the informant with intention to kill him. It is further alleged that Shambhu Singh and Bittu Singh have also assaulted the informant with knife and lathi. The informant sustained several injuries on head, left shoulder and other parts of the body. He fell down and thereafter, 5-6 unknown persons assaulted him. Dhara Singh and Shambhu

Counsel for the petitioner submits that during investigation in paragraph 27 and 28 of the case diary the witnesses have named the petitioner. There is no allegation of any specific overt act against the petitioner. Petitioner is in custody since 21.1.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VIII, Siwan, in connection with Maharajganj P.S. Case No. 18 of 2019 (Sessions Trial No. 186 of 2019), subject to the condition that both the bailors will be close relatives of the petitioner.
