Mr.Upendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-09-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

Petitioner apprehends his arrest in connection with Dulhin Bazzar P.S. Case No.86 of 2019, G.R. No.1135 of 2019, for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.

The allegation against the petitioner as per the First Information Report is that sister of the informant was killed by the petitioner along with other family members by setting her on fire.

Learned counsel for the petitioner submits that petitioner has not committed any offence and has has falsely been implicated in the present case. Learned counsel further submits that during the course of investigation, the Supervising

Patna High Court CR. MISC. No.42731 of 2019(4) dt.20-09-2019 2/2 Authority in paragraph 24 of the case diary has found that the allegation against the husband of the deceased as true under Section 306 of I.P.C.

On the other hand, learned counsel for the State referring to the case diary submits that police in his supervision note has recorded in the case diary that the deceased has committed suicide due to the fight with her husband and the case against the petitioner has been found to be true by the supervising authority.

Having regard to the submissions made by the parties and taking into consideration the fact that police during investigation has found the case to be true against the husband of the deceased under Section 306, accordingly, I am not inclined to grant anticipatory bail to the petitioner and the same is hereby rejected.
