The petitioner apprehends her arrest in connection with Bisfi (Patauna) P.S. Case No.297 of 2021 instituted under Sections 328, 302 read with Section 34 of the Indian Penal Code.

As per the prosecution story, the informant, the mother of the deceased alleged that the petitioner herein, a married lady was having affairs with number of persons, her son being one of them. As she was pressurizing him for marriage but her son wanted her to first take divorce from her husband, the allegation is/was that she administered poison. The informant's son died during the treatment in Darbhanga Medical College Hospital. In view of the allegation that has come up against the petitioner in the FIR, this Court is

Patna High Court CR. MISC. No.45790 of 2022(2) dt.03-01-2023 2/2 not inclined her the privilege of anticipatory bail, which is accordingly rejected.

The Sub-ordinate court in case of her surrender within a period of four weeks shall take up the matter and decide the same at an earliest without being prejudiced by the any of the observation made in this order.
