JUSTICE ARUN KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 376/34 of the Indian Penal Code. Allegation in brief is that while the informant went to banana orchard to attend call of nature thereafter on the point of pistol, he threatened to kill her husband and brother and committed rape.

It is submitted that the informant lodged this case after lapse of more than a month, this case was filed due to land dispute and she is a married lady other co-accused was earlier granted bail vide order dated 8.3.2017 passed in Cr. Misc. No.5600 of 2017. Having considered the said facts and circumstances,

Patna High Court Cr.Misc. No.30510 of 2017 (2) dt.07-07-2017 2/2 in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Ram Pravesh Das be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Judge-V-cum-A.C.J.M., Muzaffarpur in connection with Piar P.S. Case No.54 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
