JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-12-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. The petitioner has filed the instant application for modification of the order dated 15.05.2023 passed in Cr. Misc. No. 242 of 2023, in which he was granted bail by this Court with a condition to deposit first installment of Rs. 1,24,000/- within a period of one month after releasing from custody followed by four equal monthly installments of Rs. One lac. It is submitted by learned counsel for the petitioner that he could not comply with the earlier order dated 15.05.2023 due to his poor economic condition. Therefore, he seeks six months more time to comply with the same.

Patna High Court CR. MISC. No.50979 of 2023(3) dt.08-12-2023 2/2 It is submitted by learned counsel for the informant that petitioner does not have any intention to clear his dues. He has not deposited a single pie in the informant's account till date despite direction of this Court.

It appears from order dated 15.5.2023 passed in Cr. Misc. No. 242 of 2023 that petitioner was granted regular bail with a condition to return the entire amount of the informant within a period of five months but the same could not be complied with as yet.

In view of the causal approach adopted by the petitioner, in complying with the order dt. 15.5.2023 passed in Cr. Misc. 242 of 2023, I am not inclined to grant further period for extension.

Modification application stands rejected.
