2. The petitioner has prayed for bail in connection with Bypass P.S. Case No.36 of 2025 registered for the offence punishable under Sections 308(4), 308(5), 352, 351(2) and 3(5) of B.N.S.

3. The case of the prosecution, in short, is that the petitioner along with others started demanding rangdari of Rs. 2,00,000/- then they will allow the informant to construct the house. It is further alleged that they started abusing the informant and took away Rs. 25,000/- on gun point. They further threatened the informant to hand over rest of Rs. 1,75,000/-. After this, the accused persons fled away on the bike and scooty.

4. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.47233 of 2025(4) dt.08-10-2025 2/2 has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. The nature of allegation is general and omnibus. There is no specific allegation against the petitioner and scooty which was identified does not belong to the petitioner. It has also been submitted that petitioner is having criminal antecedent of 10 cases that is why he has been framed in this case. Nothing has been recovered from his possession. He is languishing in judicial custody since 22.03.2025.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Bypass P.S. Case No. 36 of 2025.
