This application for regular bail arises out of DRI (NDPS) Case No. 15/18-19 NDPS Case No. 40/18, arising out of Enq No. 231 of 2018 disclosing the offence under Sections 20, 23, 25, 29 of the NDPS Act.
Consequent upon recovery of 881.100 kg of ganja (Net Weight) by the officers of Directorate of Revenue Intelligence (DRI), the present case has been registered. Learned Additional Solicitor General of India has rightly pointed out that Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985 is attracted. It appears that the petitioner has criminal antecedent,
Patna High Court CR. MISC. No.48589 of 2019(3) dt.04-12-2019 2/2 as disclosed in paragraph-3 of the application. The petitioner is owner of the truck from which the recovery of the articles has been made. It was he who was found to be driving the said vehicle.
In my view, considering the petitioner's antecedent and the nature of allegation, the Court cannot record a satisfaction as required under Section 37 of the NDPS Act to entertain the petitioner's application for grant of bail. This application is accordingly rejected.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is in custody since 11.12.2018. It is observed in the said background that let effective steps be taken for expeditious conclusion of the trial arising out of the aforesaid case by the court below.
