This writ application has been filed by the petitioner for commanding the respondents to remove the encroachment over the Raiyati land of the petitioner situated in village Satghara in the District of Madhubani over Khata No. 282/192, Plot No. 497 area 2 Katha 11 dhurs 3 Kanwa of land. The petitioner submits that for removing the illegal encroachment, the petitioner had filed a representation dated 30.12.2015 (Annexure-4) before the Circle Officer, Rajnagar. Thereafter, the Circle Officer, Rajnagar vide letter dated 05.09.2016 (Annexure-C series) had required the petitioner to

The petitioner did not file any additional documents before the Circle Officer, Rajnagar. From Annexure-B which is a letter dated 10.09.2016 addressed to the Circle Officer, Rajnagar it further appears that the petitioner did not produce Kewala or Khatiyan in relation to the land belonging to the petitioner.

3. The learned counsel for the petitioner submits that he would be satisfied if the Circle Officer, Rajnagar is directed to dispose of his representation (Annexure-4) within a fixed time frame.

4. The learned counsel appearing for the respondentsState has no objection to this.

As prayed for by the petitioner, this writ application is disposed of directing the Circle Officer, Rajnagar Madhubani to decide the representation of the petitioner dated 31.12.2015 within two months from the date of production of copy of this order after giving an opportunity of hearing to the petitioner. The final order should be a well reasoned and speaking order. While appearing before the Circle Officer, Rajnagar, the petitioner will have the opportunity to produce additional
