====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 18-07-2019 Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in a case registered for the offences punishable under Sections 30(a) and 56(d) of the Bihar Prohibition and Excise Act, 2016.
From a four wheeler, foreign liquor was allegedly recovered. The petitioners were apprehended from the said car. Petitioners have stated on oath that they have got no criminal antecedent. Prosecution report has been submitted without proper investigation of the case.
Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties
Patna High Court CR. MISC. No.44012 of 2019(2) dt.18-07-2019 2/2 of the like amount each to the satisfaction of learned Court below where the case is pending in connection with G.O. Case No. 104 of 2019, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners as well as condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below.
