Admittedly, the victim returned to her home and her statement u/S 164 of the Cr. P.C. was recorded, which is evident from paragraph-56 of the case diary.

The victim stated that she was allured by the petitioner and after that, she alone went his home. She further stated that she was offered a cup of tea and after that, she became unconscious. Furthermore, she admitted that she was brought to Ramashish Chowk by the petitioner.

Admittedly, at the time of her statement, the victim was found 19 years of age by the concerned court and similarly, Medical Board also found the victim 20 years of age. Therefore, considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner, named above, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.37266 of 2014 (3) dt.28-01-2015 bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Vaishali P.S. Case No. 78 of 2014 to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur.
