2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 303(2) and 76 of the B.N.S., 2023.
3. The allegation in the FIR is that the petitioner along with other accused persons came variously armed to the house of the informant and indulged in hurling abuses and assault. On intervention made by the husband of the informant Dashrath Choudhary, it is alleged that this petitioner along with one Sanjay Paswan assaulted him with an iron rod on the head. 4. Learned counsel for the petitioner submits that all the accused persons belong to one family and both the parties are co-villagers. The injuries caused to all the three injured persons in the present case appear to be simple in nature caused by hard and blunt substance and the said injury report has been annexed as Annexure-P/2 to the present application. So far as the petitioner is concerned, the injury of Dashrath Choudhary is attributable to him and his injury report clearly shows that he sustained simple injury. It is also pointed out that the similarly situated co-accused, namely, Sanjay Paswan has already been granted the privilege of anticipatory bail by this Court vide order dated 26.03.2025 passed in Cr. Misc. No. 11195 of 2025.
5. Learned APP for the State, however, opposes the prayer for anticipatory bail on the ground that this petitioner has one criminal antecedent. In response to the same, it is submitted on behalf of the petitioner that the said case is of the year 2013 and the petitioner is on bail in the said case.
6. Considering the entire facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the petitioner. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four
