Petitioner in the present case is seeking anticipatory bail in connection with Jadopur P.S. Case No. 11 of 2019 registered for the offences punishable under Sections 341, 323, 307, 504, 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that both the parties are Pattidars and there is a land dispute between the parties. There are general and omnibus allegations against petitioners and there is also a counter case.

Considering the facts and circumstances of the case, wherein there is an allegation against the petitioner no. 1 Ravi

No.46060 of 2019(3) dt.26-09-2019 2/3 Kumar that he had assaulted Sri Bhagwan Singh by giving a farsa blow on his head, this Court is not inclined to grant privilege of anticipatory bail to the petitioner no. 1, in case he surrenders in the court below and prays for regular bail within a period of four weeks from today, his prayer for regular bail shall be considered on the basis of materials available on the record without being prejudiced by the order of this Court, and further consideration being given to the nature of injury and the contention is that there is a land dispute between the parties.

So far as petitioner nos. 2 and 3 are concerned, since there are general and omnibus allegations against them and there is a counter case, let the petitioner nos. 2 and 3 in the event of their arrest or surrender within a period of four weeks from today be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gopalganj in connection with Jadopur P.S. Case No. 11 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. i.e. (i) a condition that the person shall make himself available for interrogation by a police officer as and when required;

(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person
