1. After some argument, it comes to the knowledge of this court that the processes under Sections 82 and Section 83 of Cr.P.C. have been issued against the petitioner and it is submitted by Ms. Anita Kumari, learned APP appearing for the State that the prayer for anticipatory bail of the petitioner is not maintainable.
2. After above submission, learned counsel for the petitioner seeks permission to withdraw this petition with a liberty to move for regular bail before the trial court.
3. Considering the above submissions as well as prayer, the instant petition stands dismissed as withdrawn with giving liberty to the petitioner to surrender before the trial court within four weeks from today. If he surrenders within the
Patna High Court CR. MISC. No.52714 of 2024(2) dt.29-08-2024 2/2 stipulated period then the learned trial court shall decide his regular bail prayer on the same day keeping in view the petitioner's fair and clean antecedent.
