1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner is apprehending his arrest in connection with Bettiah Town P.S. Case No. 221 of 2022 registered for the offences punishable under Sections 379 and 356 of the Indian Penal Code, later on Section 411 of the I.P.C. has been added.
3. As per prosecution case, an unknown person showing fear of knife snatched the purse, mobile (9875479773), tab (7543966762) and other articles of the informant.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of present petitioner transpired in the present case on the basis of confessional
Patna High Court CR. MISC. No.46993 of 2023(2) dt.04-08-2023 2/2 statement of co-accused Saddam Hussain. Petitioner bears three criminal antecedents. Petitioner is innocent and has committed no offence as alleged in the F.I.R.
5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner and submits that petitioner bears three criminal antecedent and he is in habit to commit serious nature of offence.
6. Considering the facts and circumstances of the case, nature of allegation coupled with criminal antecedent of the petitioner, I am not inclined to grant anticipatory bail to the present petitioner. Accordingly, prayer for anticipatory bail of the petitioner is hereby rejected.
