2. The petitioner seeks bail in connection with Ujiyarpur P.S. Case No. 57 of 2023 registered for the offence under Sections 302, 342 and 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of killing the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and the police, after investigation has submitted the final form exonerating the petitioner but the learned Magistrate has taken cognizance against the petitioner differing with the final form. Chargesheet was submitted under Section 304(B) of the Indian Penal Code.

5. The petitioner is in custody since 15.03.2023.

6. Considering the facts and circumstances and also

Patna High Court CR. MISC. No.49934 of 2024(3) dt.22-11-2024 2/2 the period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge, Dalsinghsarai, Samastipur/concerned Court in connection with Ujiyarpur P.S. Case No. 57 of 2023.
