JUSTICE SANJAY PRIYA ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Khaira P.S. Case No. 47of 2017 instituted for the offence under Sections-307, 385, 427 & other minor sections of the Indian Penal Code as well as 27 of the Arms Act.
As per written report, there is specific allegation against this petitioner of causing fire arm injury on the head of the informant. The learned Sessions Judge has also mentioned in the impugned order that the doctor examined the injured and the injury report is available in paragraph-14 of the C.D. from perusal of which, it transpires that the doctor found lacerated wound on left side of forehead and in X-ray found pillet which was removed. The doctor found the injury simple in nature. This court seeing the specific allegation against the
Patna High Court Cr.Misc. No.32147 of 2017 (2) dt.13-07-2017 2/2 petitioner, of causing fire arm injury on the forehead, is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected.
The petitioner is directed to surrender in the court below and seek regular bail which will be considered on its own merit without being prejudiced by this order. (Sanjay Priya, J) A.K.V./- U T
