The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Bhagawanpur P.S. Case no. 104/2021 instituted for the offence under Sections 341, 323, 504, 506, 307, 34 of the Indian Penal Code and Section 27 of Arms Act. It is a case of opening fire on the informant's son Sandeep Dubey by the petitioner due to which he received gun shot injury in his right upper arm.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. In fact informant was not to give grievous hurt to the
Patna High Court CR. MISC. No.59976 of 2021(3) dt.12-07-2022 2/2 petitioner but point of pistol mistakenly moved towards his son and firing opened which hit him on his hand. . There is case and counter case.
Learned counsel for the informant and learned APP appearing for the State has opposed the prayer of bail and submitted that fire arm injury was found on the body of the victim. Doctor has opined the nature of injury to be grievous in nature caused by bullet.
Having heard learned counsel for the parties and taking into consideration that there is direct allegation of firing against he petitioner, I am not inclined to grant bail to the petitioner and, as such, his application for bail is rejected. (Sunil Kumar Panwar, J) sushma/- U
